Letters to the Honorable John McEneny regarding window guards

Dear Assemblyman McEneny:
I have a proposed ordinance (enclosed) pending before the Common Council of the City of Albany requiring the installation of window guards on “every building of residential or mixed occupancy and having rental units located above the first floor.” The Common Council’s Law Committee will be taking this proposed legislation up at its May 15 meeting. If the ordinance is released from committee, I am planning on having the full Council vote on the ordinance at its May 19 meeting (Youth in Government Day – sponsored by The Elks).
Query 1: Under state law, are window guards considered a “capital improvement” so as to exempt the purchase and installation costs from the sales and use tax? If not, I would appreciate it if you could introduce legislation that would exempt window guards from the sales and use tax.
Query 2: Is it possible to amend the Insurance Law to require property insurance companies to give a premium rate reduction to rental property owners who install window guards?
